Terms and Conditions
1. REFERENCES to "we", "our" and "us" refer to ‘owners or agents’ only, “lead name” refers to ‘person making the booking reservation’, “you” and/or “your” refer to the ‘lead name’ and/or ‘guests’. 2. BOOKING CONDITIONS: A non refundable deposit of £100 per week is required to secure your booking and this is to be sent with the completed booking form. All correspondence must be via the lead name he or she must be over 18 years of age and is responsible for all payments. Once the booking form is accepted by us your dates will be secured and a confirmation invoice returned to the lead name at the address given on the booking form, this will form ‘the contract’ between both parties. Note: a formal contract will only exist when a confirmation invoice is returned to the lead name. Please check your confirmation details carefully especially the due date of your balance. The balance of your holiday booking will become payable 8 weeks before departure, if payment is not received on or before this date we reserve the right to cancel your booking with loss of deposit or at our discretion we may charge an administration fee for the continuation of the booking. If the booking is under 10 weeks before departure then the full payment is payable at the time of booking along with the security deposit. 3. SECURITY DEPOSIT: A security deposit (cheque for) £100 per week will also be required at the time of the final balance, this will not be cashed, and will be returned within 6 weeks of your return home subject to confirmation with our management company that the villa and its contents are in the same condition as on your arrival. Any damage, breakage’s, excessive use of the phone or utilities and/or leaving the villa in such condition that warrants extra cleaning will be made good from your security deposit (cheque) along with an administration charge, if any loss or damage is in excess of the deposit an account will be sent to the correspondence address and will be due for immediate settlement. 4. DATA PROTECTION: In order to process your booking we need to use the information you provide such as name, address, telephone or any special needs or requirements. We will only pass on the required information from the booking form to our management company to assist in verification purposes only on your arrival, if necessary. We may also use this information to offer you accommodation at a future date unless you specify otherwise on your booking form, we guarantee the information you provide will not be passed to any third party for advertising or other public notification. 5. LIABILITY LIMITATIONS: We will not be held responsible for loss or delay howsoever caused beyond our control i.e.: strikes, riots, fire, war, threat of war, terrorist activity, industrial dispute, flight delays or cancellations, natural disasters, adverse weather conditions, flood, transport problems of any kind and weather conditions. The villa is in a residential area and as such we cannot be held accountable for any noise from neighbours and/or nearby building work that may be ongoing or any other event etc. (this list is neither exclusive nor exhaustive). 6. USE OF THE VILLA: Only the persons named on the booking form are allowed to use the villa and the facilities at the development (this is a requirement of Florida State Law). We would like to remind you that for the enjoyment of future guests this property has a strictly NO SMOKING POLICY in all indoor areas, loss of security deposit resulting from this instruction being ignored, will be enforced. Refuse/Garbage bins should be placed outside on the prescribed pick up day and once emptied returned to their original location as soon as practicable (during same day where possible), failure to comply may result in a fine being awarded by the home owner’s assurance and any charge of this nature will be deducted from the security deposit. 7. PROPERTY SAFETY AND SECURITY: The pool is maintained by a responsible person however, it is private to you for your use during your stay and therefore unsupervised. Liability for the use of the pool is at your own risk, no diving is permitted and guests are specifically requested not to allow unsupervised children to use the pool areas at any time. We cannot accept liability for any damage or loss to any personal property or possessions or any personal accident sustained by you, your party members or any visitors and therefore advise all guests to purchase comprehensive holiday insurance for the full duration of your stay. You will be given a security access code prior to departure this will be required to access the key box on arrival, the property key will be within this box, the property key is your responsibility, loss of this key will result in a levy charge being released from your security deposit for a replacement lock and key plus administration charge. 8. ARRIVAL / DEPARTURE: The rental commences at 4PM on the day of arrival and ceases at 10AM on the day of departure with no exceptions this ensures that cleaners have sufficient time to ensure the property is maintained at the high standard we require for new guests arriving. The property will be cleaned before your arrival and again on your departure. 8.1 A negotiable overstay fee is available and will be charged at £15.00 ($25.00) ‘per hour or part hour thereof’ if the property is to be vacated later than the allotted time, your co-operation is required in compliance with this requirement. 8.2 Overstay charges: £35 ($50.00) per hour or part thereof will be charged for non negotiable departure periods after the 10 am departure allocation. 8.3 Exception—overstay charge may be reduced or waived, in exceptional circumstances, if formal arrangements are made with us prior to your departure date. 9. EXTRAS: Cots and bedding can be provided however an additional charge will be levied for this facility. 9.1 High speed broadband internet access is provided an additional charge for this utility will be charged at a weekly rate, rates applicable at time of request. 9,2 The rental is inclusive of electricity, water and local sales taxes but not any required pool heating. Note: a charge will be levied if pool heating is required during the rental period, contact us for further details. 9.3 Telephones are available for your use in the villa with local calls and national US calls being free of charge you will however require a pre-paid phone card for international calls. 10. DISCOUNTED RATES AVAILABLE 10.1 PRICE PROMISE: We will better any vacation rental quote for a similar standard home, this means an executive central Florida villa built in the last four years of like accommodation, with pool and furnished to comparable standards. Send your best price and ‘url’, e.g. www.example.com, link for the related property to us and subject to availability at time of booking plus our acceptance of the related property as of a similar standard, we will better the price. 9.2 TELL A FRIEND We offer a ‘tell a friend and/or family’ discount, this applies to any guests recommending kokomosun to their friends and/or family, on confirmation of booking and full balance being paid by your friend and/or family you will be entitled to a discount of £100 off your next stay at kokomosun. 9.3 LATE AVAILABILTY discount is subject to a confirmed booking being made within 21 days of arrival date, contact us at kokomosun@homecall.co.uk for details. 10. CANCELLATIONS: In the event of your cancelling your booking the following charges will apply: CANCELLATION CHARGES More than 8 weeks - Charge: Loss of deposit More than 4 weeks - Charge: 50% of all monies paid and due, less security deposit Between 2 to 4 Weeks - Charge: 75% of all monies paid and due, less security deposit Less than 2 weeks - Charge: 100% of all monies paid and due, less security deposit All cancellations must be confirmed in writing by the person who made the booking. We will gladly provide proof of payment of a booking for the purpose of any valid insurance claim. Any changes to a booking once the form has been received will incur a £15 administration charge. In the unlikely event that we have to cancel your booking due to circumstances beyond our control we will endeavour to find suitable alternative accommodation for your stay, should you choose to decline the alternative accommodation offered or we are unable to provide alternative accommodation, we will refund the actual monies paid to date in respect of your booking, in full. No liability for any additional compensation in respect of the cancellation shall be levied against us. 11. TAXES All bookings are subject to local Florida sales tax, currently (12%), this is included in the weekly rate. |
